1. Introduction

Pinturas Portugal, operated by Ferras & Gouvea, Lda, a private legal entity, NIPC 517 850 796, headquartered at Rua Ricardo Reis nº7 8ºD, 2675-239 Odivelas, Portugal, acts as an intermediary platform between clients in need of painting services and verified painters. These Terms & Conditions govern the use of the platform and establish the rights and duties of the parties involved.

2. Nature of the Service

Pinturas Portugal does not provide painting services:

  • The execution contract is entered into directly between the CLIENT and the PAINTER.
  • The platform is limited to providing intermediation, payment management, and administrative support.

3. Responsibilities of the Platform

The platform has the following responsibilities:

  • Select and recommend a verified PAINTER for the execution of the work
  • In case of non-compliance by the PAINTER, make efforts to find another professional to complete the work
  • Hold CLIENT payments in custody until the completion of the work and guarantee the reservation of the date
  • If the PAINTER provides the materials, the platform releases the payment of this amount to the painter upon presentation of an invoice
  • Provide a support line for CLIENT assistance. This line is available for administrative support and, when possible, to assist in conflict mediation.

4. Responsibilities of the Painter

The painter has the following responsibilities:

4.1 Execution of the Work

Perform the work in accordance with best practices, within the deadlines agreed with the CLIENT, and according to the characteristics of the service contracted by the CLIENT, as visible on the platform. In case of non-compliance with the service and/or agreed deadlines, the Platform reserves the right to withhold full payment to the painter.

4.2 Quality and Invoicing

The painter must:

  • Ensure the quality of the service provided and the proper application of the materials used
  • Issue the invoice corresponding to their work (labor), according to the agreed budget visible on the platform. All values presented on the platform include VAT at the applicable legal rate
  • Take full responsibility for any issues in the execution of the work, including defects or delays in delivery

4.3 Independent Activity

The PAINTER acts independently and is not an employee or subcontractor of the platform. Any occurrence at the work site is the responsibility of the PAINTER.

  • The PAINTERS registered on the platform act as independent service providers.
  • There is no labor, corporate or subordination relationship between the painters and the PLATFORM.
  • Each PAINTER is entirely responsible for the quality, execution, legal compliance and safety of the services they provide, as well as the truthfulness of the information provided to the CLIENT.

4.4 Extra Services

The PAINTER is responsible for notifying the platform of any extra services agreed with the client. These services will be paid and processed through the platform. The Platform reserves the right to charge a commission on these extras, visible to the PAINTER online.

4.5 Code of Conduct

The PAINTER is responsible for respecting the platform’s code of conduct. In case of non-compliance, the Platform reserves the right to block the PAINTER’s access.

  • Punctuality - Always respect the scheduled time with the client.
  • Realistic commitment - Only give deadlines you can meet.
  • Meeting deadlines - Deliver the work on the agreed date.
  • Managing extras - Any extra must be added to the platform and only proceed after client approval.
  • Deadline changes - If there is a change to the delivery date, notify the client at least 24 hours in advance.
  • Visit delays - If unable to arrive on time, inform the client as early as possible to maintain trust.
  • Cleanliness - Always leave the site clean and organized at the end.
  • Professional conduct - Do not smoke inside the work site. Keep the space clean at all times.

5. Responsibilities of the Client

The CLIENT has the following responsibilities:

  • Provide accurate, truthful, and complete information about the property and painting needs
  • Make payments to the Platform according to the agreed amounts and deadlines
  • Allow access to the work site for execution within the established deadline
  • Report any problems directly to the PAINTER, requesting a solution within the agreed timeframe
  • Confirm that all information provided to the Platform is truthful and complete for an accurate estimate
  • In case of conflict with the PAINTER, immediately notify the platform so it can investigate and assist in conflict mediation

6. Selection and Confirmation of the Painter

The CLIENT has the following responsibilities:

  • The Platform makes the CLIENT’s request available to registered PAINTER(S), with the initial assignment of the work following availability order (first PAINTER to accept the request).
  • Nevertheless, the final selection of the PAINTER is always the sole responsibility of the CLIENT, who must expressly confirm their choice before the start of the work.
  • After the initial indication of the available PAINTER by the Platform, the CLIENT has a maximum of 24 (twenty-four) hours to confirm or reject the selection of that PAINTER.
  • If the CLIENT does not respond within this period, it will be considered that the CLIENT tacitly accepted the indicated PAINTER, automatically entering into the execution contract directly between CLIENT and PAINTER, without any intervention or responsibility from the Platform regarding the execution of the work.
  • Acceptance of the PAINTER by the CLIENT constitutes the execution contract directly between CLIENT and PAINTER, without any intervention or responsibility of the Platform regarding quality, deadlines, materials, defects, or results of the work.
  • The Platform only manages the request flow, payment custody, and administrative support, and does not assume responsibility for problems arising from the execution of the work.

7. Release of Client Payments

CLIENT payments will be made in two stages:

  • First installment (50%): deposited by the CLIENT through the online platform at the time of booking the service date.
  • Second installment (50%): paid by the CLIENT to the Platform after the completion of services. By making the final payment, the CLIENT agrees that the service is marked as completed.
  • Extra installments: if the CLIENT wishes to contract extra services not previously agreed upon, a payment of 50% of the total value must be made before the PAINTER proceeds with the service. The remaining amount will be paid together with the second installment.

In case of a dispute regarding the quality or completion of the service, the amounts will remain in custody of the Platform until the conflict is resolved.

8. Limitation of Liability

The Platform acts exclusively as an intermediary and does not assume any direct responsibility for the execution, quality, or any problems in the work performed by the PAINTER.

8.1 Complain about Quality

Any complaint regarding the quality of the service must be addressed directly to the PAINTER responsible for the work

8.2 Limitation of Liability

The Platform is not responsible for

  • Damages, losses or damages resulting from the execution of the contractual relationship between CLIENT and PAINTER
  • Illegal, criminal, negligent or deliberate acts by the PAINTERS before, during or after the execution of the work and provision of services
  • Delays, non-compliance or failures in the execution of the contracted work.
  • Any complaint, litigation or disagreement between CLIENT and PAINTER.
  • Problems of condensation, humidity, leaks, structural cracks, or any other pre-existing problems in the property that may affect the painting result
  • Problems of quality of the service provided by the PAINTER
  • Problems of deadlines agreed between CLIENT and PAINTER
  • Problems of materials used by the PAINTER
  • Problems of safety in the work

8.3 Choice of PAINTER

The CLIENT acknowledges that the Platform does not assume any responsibility for the choice of the PAINTER, being the sole responsibility of the CLIENT.

9. Procedure in Case of Defects or Complaints

9.1 Complaint Procedure

  • The CLIENT undertakes to provide photographs, videos, or other evidence that allows evaluation of the alleged defects of the contracted service. In the absence of such evidence, the PLATFORM reserves the right to consider the complaint as unvalidated and the service as completed.
  • When the identified defects are exclusively of a non-structural and correctable nature, the CLIENT accepts that the priority solution will be the correction of the service.
  • The CLIENT acknowledges and accepts that a total or partial refund will only be applicable when: (i) the defects are serious or structural, (ii) correction is impossible or disproportionate, (iii) correction imposes excessive inconvenience. Whenever applicable, the proportional price reduction (partial refund) may be effected by waiving part or all of the final payment installment, when this has not been settled.
  • When the identified defects result from situations not attributable to the PAINTER, the work is considered completed, without responsibility on the part of the PLATFORM or the PAINTER.
  • The PLATFORM acts exclusively as an intermediary in the relationship between the CLIENT and the PAINTER, and fulfills its legal obligation by providing an adequate solution, namely the correction of the service. Only in the cases provided for in this clause may a refund be considered.
  • If the need for correction is determined, the CLIENT undertakes to allow access to the property for the execution of work by a qualified PAINTER from the platform. The unjustified refusal of the user to allow correction may result in the closure of the process and the completion of the service.

9.2 PAINTER Responsibilities in Case of Complaint

  • In case of proportional price reduction, total or partial refund, or any compensation granted to the user due to reasons attributable to the painter, the corresponding amount will be deducted, in the same proportion, from the amount to be paid to the painter for the work in question, with the painter expressly accepting such deduction as a form of attribution of responsibility.
  • If the PAINTER refuses, without valid reason, to proceed with the correction or completion of the work necessary to repair defects attributable to their performance, it is considered that they have not fulfilled their contractual obligation, and the PLATFORM may retain the total amount to be received or financial compensation associated with the work, without this generating any right to compensation on the part of the painter.

10. Classification of Defects

For the purposes of analyzing complaints and defining applicable solutions, the defects reported by the user are classified as follows:

10.1. Non-Structural Defects (Correctable)

Non-structural defects are considered to be all imperfections of an exclusively aesthetic nature, easily correctable and that do not cause any material damage to the property. Included, in particular but without limitation:

  • roller or brush marks;
  • coverage failures;
  • small drips or stains;
  • finish irregularities;
  • need for small touch-ups after drying;
  • small paint projections removable by simple cleaning;
  • slight sanding imperfections;
  • irregular lines between walls, ceilings or baseboards.

10.2. Serious Defects (Damaging or Non-Correctable)

Serious defects are considered to be permanent material damages, structural or requiring intervention from professionals outside the painting area. Included, in particular:

  • damage to doors, baseboards or wood elements requiring carpentry;
  • furniture permanently damaged by non-removable paint;
  • paint spilled and dried on fabrics, carpets or porous surfaces;
  • glass or surfaces scratched by abrasion;
  • tiles damaged by technical error;
  • damage to electrical equipment, outlets or switches;
  • displacement, breakage or deterioration of fixed elements (light fixtures, curtain rods, supports, etc.);
  • any damage requiring the hiring of external professionals.

10.3. Situations Not Attributable to the Painter

The following are not considered execution defects and do not generate the right to correction, price reduction or refund:

  • pre-existing humidity that causes bubbles or peeling after painting;
  • infiltrations or structural problems of the property;
  • efflorescence, micro-cracks or natural degradation of walls;
  • performance or coverage differences resulting from paint supplied by the client;
  • subsequent changes to the work not related to the painter's performance.

11. Termination and Cancellation

The cancellation conditions are as follows:

  • The CLIENT has the right to cancel the services up to 24h before the start.
  • If the CLIENT decides to cancel the services before the painting begins and no new date is agreed, the Platform will refund the amount initially paid, deducting administrative costs and any costs incurred with material purchases. The refund will be made within 5 business days.
  • If the CLIENT cancels the services after the start of the work, the Platform will retain the initial payment and reserves the right to receive proportional payment for the work performed.

12. Evaluation and Security

  • The PLATFORM may provide evaluation and feedback mechanisms for PAINTERS and CLIENTS
  • The collection of documentation or information from painters is done only for informational purposes and has no relation to the execution of the work
  • The PLATFORM does not guarantee the suitability, technical capacity, quality or future conduct of the registered PAINTERS

13. Termination

  • If the PLATFORM provides optional insurances, these will have complementary character.
  • The hiring of insurance does not replace the individual responsibility of the PAINTER or CLIENT.

14. Limitation of Guarantees

The User acknowledges that the PLATFORM is provided "AS IS" and "AS AVAILABLE" ("as is" and "as available"), without any express or implied warranty regarding continuity, quality, or result of use.

15. Amendments to the Terms & Conditions

The Platform reserves the right to amend these Terms & Conditions at any time. Changes will take effect after publication on the website.

    16. Jurisdiction and General Provisions

    The general provisions are as follows:

    • The parties choose the court of the Lisbon district to resolve any disputes regarding these Terms & Conditions
    • The CLIENT acknowledges the Platform's conditions and agrees to the terms set herein
    • By using Pinturas Portugal, both CLIENT and PAINTER agree to these Terms & Conditions
